This website (Site) is operated by Wagg & Harcombe limited, Trading as Waggs Auto Group. It is available at: www.waggsonline.co.nz and may be available through other addresses or channels. Throughout the site, the terms “we”, “us” and “our” refer to Waggs & Harcombe Limited.
We may at any time and at our discretion, vary these Terms by publishing the varied Terms on our Site. We recommend you check our Site regularly to ensure you are aware of our current terms. Materials and information on this Site (Content) are subject to change without notice. We do not undertake to keep our Site up-to-date and we are not liable if any Content is inaccurate or out-of-date.

Purchasing of Products & Supply
You may order Products by selecting and submitting your order through the Site in accordance with these terms and conditions.
Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges and taxes) at the time you place the order.
We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site.
You agree to provide us with current, complete and accurate details when asked to do so by the Site.
We reserve the right to accept or reject your order for any reason, including (without limitation) if the requested Product is not available, if there is an error in the price or the product description posted on the Site or in your order.
If we reject an order placed through the Site, then we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.
Illustrations and photos contained in this Site are sample representation of the Products advertised, and variations may occur from time to time
Any issues with the quality of goods provided will be handled under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 and the warranty conditions offered by the manufacturer.
Prices, Services and Charges
The prices of Products and delivery and other charges displayed on this Site are current at the time of issue, however, Wagg & Harcombe Limited reserves the right to change prices at any time before we accept an order from you.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
All prices shown on this Site are in New Zealand Dollars (NZD)
We will charge you, and you agree to pay, the following fees and charges in relation to an order that we accept (as applicable):
- The purchase price of each Product that is ordered;
- The delivery fee for delivering the Products to you; and
- Any other fees and charges set out in these terms and conditions.
All fees and charges identified in these terms and conditions and all prices for the Products as shown on the Site are inclusive of GST
You acknowledge that we are not required or obliged to match any prices for any Products, including matching any prices for a Product that is available through the Site at our store or vice versa.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
Delivery Fees & Shipping Information
Delivery fees are payable in addition to the purchase price of each Product. A number of different delivery methods may be used depending on the type of order
Wagg & Harcombe Limited ship to New Zealand addresses only.
You acknowledge and agree that you may incur additional delivery fees/freight charges (in excess of the fees and charges specified above) for:
- Special, non-stock and/or bespoke items;
- Heavy, bulky and/or awkward items;
- Express or urgent deliveries; or
- Bulk or large quantity orders.
Please allow at least ten (10) working days for delivery from the receipt of your order and payment for your order. Delivery time is subject to stock availability.
A tracking number will be sent to the purchaser when items have been dispatched.
We do not offer “bike in a box” delivery as we believe it’s important that every bike is assembled correctly by a professional. We will ship your purchase to an approved brick-and-mortar dealer to assembly your bike. Assembly fees are not included in the purchase price of the product and are the receivers responsibility to pay for these charges.
Our operating hours are Monday to Friday 7.30am – 5.00pm. Any orders placed during “non-working” hours will be sorted and dispatched during normal business hours. This also includes public holidays.

Our Site may contain links to websites operated by third parties. Unless we tell you otherwise, we do not control, endorse or approve, and are not responsible for, the content on those websites. We recommend that you make your own investigations with respect to the suitability of those websites.

Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.
Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.
Applicable law and jurisdiction
Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.
Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.
Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).
You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.
We reserve the right to change these terms and conditions from time to time by notice, which may be in the form of a notice posted on our website at www.waggsonline.co.nz
If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.
